Enhancing Practice08/28/2020Arizona’s Supreme Court voted unanimously to eliminate its ethics rule barring nonlawyers from having an economic interest in a law firm or participating in fee sharing, reported Lyle Moran of the ABA Journal, making it the second state in recent weeks to approve opening the door to non lawyer ownership or investment in law firms as a means of expanding access to justice. The court also approved a modification to the licensure process that will allow nonlawyers called “Legal Paraprofessionals” to provide limited legal services to the public, including being able to go into court with their clients.
Enhancing Practice08/27/2020Australia’s Flinders University is launching a six-month online course to teach lawyers how to code, open to practitioners around the world, reported Richard Tromans of Artificial Lawyer.
Enhancing Practice08/27/2020The COVID-19 pandemic has driven at least one positive outcome, wrote Josh Becker of LexisNexis in a LawSites guest column: the legal industry has been innovating in response to remote work mandates rapidly and effectively with results seen as very positive by GCs of large corporations and big law partners.
Enhancing Practice08/26/2020Having completed a 10-day virtual arbitration via Zoom, Nicole Gueron, Melissa Holsinger, Allison Pincus, and Muriel Leung of Clarick Gueron Reisbaum offered 10 lessons on how to conduct a remote hearing effectively:
  • It worked.
  • Make sure the fundamental tech works right and you know how to use it.
  • Skip the virtual backgrounds.
  • You still need hard copy for some exhibits.
  • Hide your self view – you will only get distracted watching yourself.
  • Prep witnesses using the same tech you plant to use live.
  • Place more emphasis than ever on effective team communication.
  • Take breaks from the screen.
  • Find the benefits of going virtual and capitalize on them.
  • Remember that trials are a team sport and run them that way, even remotely.

Enhancing Practice08/25/2020In a guest column in LawSites, Leigh Vickery of Level 2 Legal Solutions offered thoughts on how Utah might make good use of the two-year regulatory sandbox it recently authorized.
Enhancing Practice08/25/2020Part of the two-year access-to-justice pilot program recently establshed by the Utah Supreme Court in Standing Order No. 15 provides for a new nine-member Office of Legal Services Innovation, reported Victoria Hudgins of The American Lawyer. Operating under the direct auspices of the Utah Supreme Court, the Innovation Office will establish and administer a pilot legal regulatory sandbox through which traditional and nontraditional providers may be approved to offer nontraditional legal services to the public using options not previously permitted. The 18-page Standing Order goes on to discuss various aspects of the Innovation Office including its composition, the scope of its authority, the regulatory objective driving creating of the Office and the regulatory principles that will guide the Office. The Order also addresses what the sandbox is meant to achieve and how it is to function.

Enhancing Practice08/21/2020Remote depositions are likely here to stay for two sets of reasons, opined Darren Goldman of Becker & Poliakoff PA. Technological challenges have been addressed, for the most part: screen-sharing has made it possible to work effectively with exhibits, even remotely, breakout rooms allow for side discussions, and video and audio can be recorded and synced. And costs also are lower, a sure attraction to clients.
Enhancing Practice08/19/2020A recent Illinois state court bench trial, conducted virtually, went better than expected, reported Lyle Moran in the ABA Journal’s Legal Rebels section. While there were some technical challenges, exhibits were screen-shared with witnesses, lawyers conducted cross examinations from their offices, and the the judge presided from him home.

Privacy08/27/2020In a turnaround, the new Brazilian data protection law (Lei Geral de Proteção de Dados Pessoais or “LGPD”) now will come into effect when the President signs the bill within 15 days of receiving it from Congress, reported Hunton Andrews Kurth.
Privacy08/27/2020TrustArc published its CCPA Readiness Market Report 2020, in which the company reported that as of May 2020, 53% of US-based companies either had not started or still were in the planning stages of CCPA compliance efforts.
Privacy08/27/2020Hours after the Brazilian Senate rejected a delay of the new Brazilian data protection law, the Brazilian Presidency published Decree 10.474/2020, reported Hunton Andrews Kurth. The decree, approving the regulatory structure of the new Brazilian data protection authority (the “ANPD”) and establishing its roles, will apply after the President-Director of the ANPD is officially appointed through publication in the Official Journal.
Privacy08/26/2020Privacy company Ethyca released its Q3 2020 C-Level Privacy Survey indicating that 74% of companies have plans to spend more on privacy in the coming year, reported Frank Ready of Legaltech News. 58% of respondents worried about facing penalties and 76% believe privacy issues will impact a potential customer’s willingness to do business with a company.
Privacy08/25/2020The Data Protection Supervisory Authority for the State of Baden-Wuerttemberg, one of Germany’s 17 data protection supervisory authorities, issued post-Schrems II substantive guidance on how to conduct the necessary analysis and risk assessment for cross-border data transfers, reported Christian Schröder, Shannon Yavorsky, Dennis Schmidt and Yumiko Olsen of Orrick in a post that summaries the new guidance.
Privacy08/25/2020Poland’s data protection authority, the UODO, offered guidance on email monitoring in the workplace, reported Odia Kagan of Fox Rothschild.

Departing Employees, Data Theft, and Digital Forensics

In late 2019, it was reported by Infosecurity Magazine that 72% of former employees admitted taking company data with them upon departure. Determining what actions a former employee took on a company device leading up to their departure can help assist in determining if company data was stolen or misappropriated. Did the departing employee retire or leave for a competitor? Where they forthcoming with their intent to depart or was it abrupt? Depending on the specifics of the situation, it may be advisable to perform a digital forensic investigation to help locate some answers.

It’s Never a Bad Idea to Preserve a Former Employee’s Devices

When an employee makes the decision to leave a company, it may be time to forensically preserve the contents of an employee’s business device(s), including cloud-based accounts. We are talking about devices provided by the employer for the employee to conduct their work and not personal devices. This will ensure the digital data has been collected in a manner that is admissible in court (should that be the outcome). If the device is not preserved and is reallocated to another employee, important information regarding the previous employee’s actions on the device may be overwritten.

Once the devices used by the employee have been forensically preserved, analysis may begin.

What Evidence May be Available?

USB device activity – This type of analysis includes determining what USB devices (removable storage devices) were plugged in during the system by the user. From reviewing the USB device activity in addition to file access records, it may be possible to determine whether or not file transfers to external devices have occurred on the device

Sent and received emails – Reviewing the  work email account may prove beneficial in locating possible file transfers via email to personal accounts, messages that have been deleted and who they were communicating with about their departure.

File sharing websites – From Dropbox to Google Drive, employees may use online file sharing websites and applications  to steal company data. A review of the web browser history, including active and deleted records, may show access to file sharing websites as well as possible file uploads. It’s also advisable to see if any file sharing programs have been installed on their work computer or mobile device.

Device activity prior to departure – This type of analysis can help determine what the user did on the device prior to leaving the company. Were a large number of files deleted? Were programs uninstalled or removed? This type of analysis can give you a good picture of what was going on in the days leading up to the separation

Deleted file recovery – If a former employee has deleted files before turning their device over, forensic software may have the capability to locate and restore these previously existing files.

Internet history and searches – Web browser history may play a helpful part in determining activity prior to leaving the company. Internet history analysis has the capability to show what websites were visited and when, as well as the ability to recover deleted web browser history and searches. You may also find file access records within the browser history cache which can show when files were accessed and from what location.

Conclusion

Engaging a digital forensics company to analyze a former employee’s business devices can ultimately act as a guard to protect an organization’s intellectual property. If nothing else, consulting with a digital forensics expert can assist in analyzing the situation and offering suggestions on the best way to move forward.

ACEDS President’s E-Discovery Market Prediction: Same Skills, Different Jobs

While ACEDS membership and the number of certified individuals is growing, ACEDS president Mike Quartararo expects the e-discovery industry itself might take longer to fully bounce back from layoffs and the other lingering effects of the COVID-19 pandemic.

Mike Quartararo, president of the Association of E-Discovery Specialists (ACEDS), won’t officially celebrate a year on the job until October, but he’s had more than a year’s worth of work in that time. COVID-19 has sent ripples throughout e-discovery and the legal industry general, prompting a litigation slowdown and subsequent layoffs.

Fortunately, ACEDS’ status as an online education provider has made it easier to adapt to a new world where business, industry conferences and even certifications are conducted online. Quartararo, who before coming to ACEDS served as managing director at eDPM Advisory Services and director of litigation support services at Stroock & Stroock & Lavan, believes the e-discovery sector will eventually bounce back.

However, the same jobs might be located in different places when it does. Below, Quartararo discusses why he thinks e-discovery gigs are headed away from law firms and what e-discovery professionals may need to know in a post-pandemic world.

This interview has been edited for clarity and length.

Legaltech News: This was probably not the first year that you were expecting. How did the onset of the pandemic impact your plans for this year? Is this a different e-discovery industry than the one that began your tenure at ACEDS?

Michael Quartararo: I don’t think it’s changed my view of the industry. But it’s certainly impacted us in that as a professional association in the space, we kind of count on that ability to interact with people in-person. So we’ve kind of been—as has everybody in the space—forced to go virtual with our events, our chapter meetings, attending conferences, all of those kinds of things.

Do you see the impact of COVID-19 forcing ACEDS to rethink the way that it approaches its mission long-term?

At the end of the day we’re a training and certification association, and if ever there was time to be an online education provider, it’s a good time for that. So we’ve been fortunate in that regard.

We are fortunate to be positioned to offer a lot of what we do online. For instance, we’ve pivoted from our exam is offered at a thousand testing centers around the world. It was a really light lift for us to moved it online and provide online proctored exams.

Towards the beginning of the pandemic we saw a slowdown in litigation and the resulting layoffs that occurred within the e-discovery industry. Are we starting to see that trend reverse itself?

I think it’s likely to continue for a while, in my opinion, just because it’s not quite clear. There’s more recently been a surge in layoffs. The surge has been in COVID-19 sort of rising up again across the nation and I think… the e-discovery and litigation space is probably going to be flat for a few more months until we kind of figure this out.

But I’m optimistic that everybody is adapting well and finding their way through this. I think that on the other side there will be an increase in litigation and therefore e-discovery projects, and so we’re posed to continue offering the training and certification to those who need it.

Do you think that all of the e-discovery jobs that were lost during the initial stages of the pandemic will return? Or will that talent simply be clustered in different places than before COVID-19?

I think some of it will come back, but I think that there will be a shift in the work force in that more people will go work in-house or at vendors as opposed to law firms, maybe.

But that all remains to be seen. I think it’s a big question mark… If I had to guess I would say more vendor-centric employment opportunities because I think more of the work is—as it has been for years—moving in-house. There will just be more opportunity for jobs on the vendor and corporate side than on the law firm side.

Are there new skills that e-discovery professionals will have to learn or emphasize if they hope to remain relevant in a post-pandemic world?

I think the skill set pretty much remains the same. If there’s any sort of area of specialization, I would say it’s more around dealing with issues like machine learning or AI or TAR. Those kinds of skill sets are going to become more valuable as we come out of this thing, because people are going to be looking for more efficient ways to, for example, review documents. If there’s an application that helps in that regard, I think that’s going to become a more useful skill.

And then I think on the information governance side of things with everybody moving to the cloud, understanding issues around SaaS-based offerings, maintaining those kinds of information governance protocols on the left side of the EDRM are going to become really important.
